class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><p>PEEK&#8217;IN, a simplified joint-stock company, with its registered office at 54, rue Desaix, 44 000 Nantes, registered with the Nantes Trade and Companies Register, under number 832 852 776, offers Users, as defined below, the opportunity to manage lost property found within premises open to the public, and more specifically accommodation establishments (hereinafter the &#8216;Establishment&#8217;), via the PEEK&#8217;IN application (&#8216;Application&#8217;).<\/p>\n<p>These General Terms and Conditions of Use (GTC) are entered into between the User and PEEK&#8217;IN.<\/p>\n<p>The User declares that they have the legal capacity to use the PEEK&#8217;IN services.<\/p>\n<h2 id=\"purpose\">Article 1 &#8211; Purpose<\/h2>\n<p>The purpose of the T&amp;Cs is to set out the conditions under which the User accesses and uses the App.<\/p>\n<p>The T&amp;Cs also set out the conditions under which the User places an order for the delivery of the found item (the &#8216;Item&#8217;). The User is hereby defined as a consumer, a non-professional, or a professional meeting the conditions set out in Article L221-3 of the French Consumer Code. These three categories have specific rights, as detailed in the French Consumer Code.<\/p>\n<h2 id=\"terms-of-use\">Article 2 &#8211; Terms of use<\/h2>\n<p>2.1. The User is notified by text message or email \u2013 depending on the contact details provided to the Establishment \u2013 that an item which may belong to them has been found on the premises of the Establishment. The notification includes a URL link to the App.<\/p>\n<p>2.2. Once on the App, the User is asked to read and accept these Terms of Use as well as PEEK&#8217;IN&#8217;s personal data protection policy. Failure to do so will prevent them from accessing PEEK&#8217;IN&#8217;s services.<\/p>\n<p>2.3. Once the Terms of Use have been accepted, the User will see the message regarding the Item. By clicking on the link in the notification, the User can view the description of the Item or a photograph of it.<\/p>\n<p>2.4. The User is asked to decide what to do with the Item. They may (i) declare that the Item does not belong to them, (ii) abandon the Item, (iii) opt for collection on site, or (iv) arrange for delivery.<\/p>\n<p>By selecting options (ii), (iii) or (iv), the User warrants to PEEK IN that they are free to dispose of the Item, either because they are the owner or because they have the rights to do so. They hereby indemnify PEEK IN against any claims by third parties in this regard.<\/p>\n<h2 id=\"abandonment-item\">Article 3 &#8211; Abandonment of the item<\/h2>\n<p>By clicking on the &#8216;Abandonment of the Item&#8217; tab, the User acknowledges that they hold the rights to the Item but do not wish to reclaim it. They thereby waive all rights and privileges relating to ownership of the Item. They acknowledge that the Establishment holding the Item may freely dispose of the Item, or even destroy it.<\/p>\n<h2 id=\"collection-item\">Article 4 &#8211; Collection of the item from the establishment<\/h2>\n<p>By choosing to collect the Item from the Establishment, the User is asked to select the date and time of collection via the App. They may also authorise a third party to collect the Item.<\/p>\n<p>The User warrants to PEEK&#8217;IN that they are authorised to provide, via the App, the contact details of the authorised third party for the purpose of handing over the Item.<\/p>\n<p>The User or the authorised third party will receive confirmation of their collection request via the channel (text message or email) originally used.<\/p>\n<p>The handover of the Item to the User or the authorised third party is subject to the rules laid down by the Establishment. It is the User&#8217;s responsibility to obtain the relevant information from the Establishment, in particular regarding the retention period for the Item. The Establishment may, in particular, make the handover of the Item conditional upon the prior presentation of a valid proof of identity.<\/p>\n<h2 id=\"delivery-item\">Article 5 &#8211; Delivery of the item<\/h2>\n<h3>5.1. Order process<\/h3>\n<p>The User is invited to click on the &#8216;Send to the address of my choice&#8217; tab and select the chosen delivery method (Article 5.2).<\/p>\n<p>The User should then check all the details entered.<\/p>\n<p>The User may correct any errors using the back button, by amending the information directly on the relevant page.<\/p>\n<p>The User is then prompted to proceed to payment (Article 7 below). Confirmation of the delivery is only given once payment has been made and received.<\/p>\n<p>In exceptional circumstances, the Organisation may cover the cost of the service. In this case, the delivery request is confirmed without the User being redirected to the payment page; confirmation is simply given by clicking &#8216;Confirm delivery of my item&#8217;.<\/p>\n<p>An email containing these Terms and Conditions of Use will be sent to the User&#8217;s email address to confirm the delivery request on a durable medium. This confirmation email will set out all the information covered by the general duty to provide information, as set out in Articles L221-5 and L221-11 et seq. of the Consumer Code.<\/p>\n<p>The User is therefore strongly advised to keep this confirmation email.<\/p>\n<h3>5.2. Delivery method<\/h3>\n<p>The User is asked to provide the details of the chosen delivery address and to select a delivery method from those offered via the App. The various delivery methods available to the User and the terms and conditions governing them are set out in detail on the App.<\/p>\n<p>PEEK&#8217;IN shall not be held liable in the event of an incomplete address, an incorrect address, refusal of the parcel by the recipient without valid reason, or any other lack of information regarding the delivery address.<\/p>\n<p>In the event of an error in the delivery address, a problem accessing the delivery location, or any other issue necessitating a redelivery, the redelivery may be invoiced at actual cost, on the understanding that the redelivery will only be carried out upon payment of these additional charges.<\/p>\n<h3>5.3. Delivery charges<\/h3>\n<p>Delivery charges vary depending on the geographical area concerned, the chosen delivery method, the volume and weight of the parcel, and any processing fees indicated to the User before they confirm their order.<\/p>\n<p>The delivery charges shown on the App are based on the product details provided in advance by the Establishment, which is responsible for them.<\/p>\n<h3>5.5. Countries eligible for delivery<\/h3>\n<p>Details of the countries to which delivery is available can be found on the website <a href=\"https:\/\/peekin.me\/en\/\">https:\/\/peekin.me<\/a>.<\/p>\n<p>Customs duties, other local taxes, import duties or government taxes may be payable. These shall be borne by the User and are their sole responsibility, both in terms of declarations and payments to the relevant authorities and\/or bodies in their country.<\/p>\n<h3>5.6. Delivery times<\/h3>\n<p>Delivery times depend on the time taken for the Establishment to hand over the Goods to the carrier. They are expressed in working days. Generally speaking, on-time delivery can only take place if the User has fulfilled all their contractual obligations towards PEEK&#8217;IN.<\/p>\n<p>In accordance with Article L216-1 of the French Consumer Code and unless otherwise specified by PEEK&#8217;IN at the time of the order, the delivery time shall be a maximum of six weeks from the date on which full payment is received from the User.<\/p>\n<p>In the event of a failure to meet this deadline, the User may require PEEK&#8217;IN to fulfil the order within a new timeframe. The formal notice must be sent by registered post with acknowledgement of receipt to the following address: PEEK&#8217;IN, c\/o Le Palace, 4 rue Voltaire, 44 000 Nantes. Should performance not take place within this new timeframe, the sales contract may be terminated by sending a written notice in accordance with the same procedures.<\/p>\n<h3>5.7. Delivery problems caused by transport<\/h3>\n<p>Any issue relating to the delivery must be clearly noted on the delivery note in handwritten form, accompanied by the signature of the User or the third party responsible for receiving the Product.<\/p>\n<p>The User or the aforementioned third party must state their reservations as precisely as possible: &#8216;box damaged on the left-hand side&#8217;, &#8216;scratch&#8217;, &#8216;sign of impact&#8217;, etc.<\/p>\n<p>For these reservations to be taken into account, the User must confirm the issue by sending the carrier, within 3 working days of the delivery date, a registered letter with acknowledgement of receipt setting out the said complaints. They must also send a copy of this letter by email to <a href=\"mailto:help@peekin.me\">help@peekin.me<\/a>.<\/p>\n<h3>5.8. Receipt<\/h3>\n<p>Any reservations regarding the delivery (damaged or opened parcel, broken item, missing product, etc.) must, where possible, be notified to the carrier and then reported by email to PEEK&#8217;IN via the address <a href=\"mailto:help@peekin.me\">help@peekin.me<\/a> or by post. The User must provide evidence, such as photographs, to confirm the existence of the issues observed so that the matter can be dealt with appropriately.<\/p>\n<p>PEEK&#8217;IN will advise the User on the steps to be taken.<\/p>\n<h2 id=\"reviews\">Article 6 &#8211; Reviews<\/h2>\n<p>6.1. By posting a review on the App in the space provided for this purpose, the User undertakes not to use any content that may be unlawful; in particular, they undertake not to publish any content contrary to public order and\/or public decency.<\/p>\n<p>6.2. By posting a review on the App, the User authorises the publication of the review on PEEK&#8217;IN&#8217;s partner websites. Publication is subject to agreements between PEEK&#8217;IN and the Establishment.<\/p>\n<h2 id=\"financial-terms\">Article 7 &#8211; Financial terms<\/h2>\n<h3>7.1. Prices<\/h3>\n<p>The prices shown on the App are quoted in euros (\u20ac) inclusive of VAT. They include the PeeK&#8217;In App service fee (calculated as a percentage of the delivery charges, starting from \u20ac6 inclusive of VAT), the transport and freight charges of the service provider chosen by the User, as well as any optional compensation charges selected by the User, in accordance with the PeeK&#8217;In price list, in the event of a parcel being reported lost by the carrier.<\/p>\n<p>VAT is charged at the current statutory rate in France. Should the French VAT rate change, prices including VAT will be adjusted immediately, without prior notice to the User.<\/p>\n<h3>7.2. Payment methods<\/h3>\n<p>Payment is made by credit\/debit card (with or without Apple Pay and Google Pay) or via PayPal.<\/p>\n<p>In the event of payment by credit\/debit card, the User expressly acknowledges that providing their card number constitutes authorisation to debit their account for the total amount corresponding to the price stated on the App.<\/p>\n<p>Where payment is made via PayPal, payments are processed directly on the PayPal website via pages secured using the SSL (Secure Socket Layer) protocol.<\/p>\n<p>Regardless of the payment method, PEEK&#8217;IN uses PCI-certified payment gateways (Stripe, PayPal) which guarantee the User that only the bank holds confidential information (card number, expiry date). PEEK&#8217;IN does not have access to this information.<\/p>\n<p>The User warrants to PEEK&#8217;IN that they have the necessary authorisation to use the chosen payment method. PEEK&#8217;IN reserves the right to suspend services in the event of payment being declined by officially accredited organisations or in the event of non-payment.<\/p>\n<h2 id=\"right-withdrawal\">Article 8 &#8211; Right of withdrawal<\/h2>\n<p>In accordance with Article L.221-18 of the Consumer Code, the User, whether a consumer or a non-professional, has a period of fourteen days from the conclusion of the contract to exercise their right of withdrawal.<\/p>\n<p>However, as this concerns the provision of services and in accordance with Article L.221-28 of the French Consumer Code, by accepting the Terms and Conditions of Use, the User consents to the full performance of the Service before the end of the withdrawal period and expressly waives their right of withdrawal.<\/p>\n<h2 id=\"intellectual-property\">Article 9 &#8211; Intellectual property<\/h2>\n<p>The User&#8217;s use of the Service shall not be construed as conferring upon the User any intellectual property rights in the Application and\/or its content.<\/p>\n<h2 id=\"data-protection\">Article 10 &#8211; Protection of users&#8217; personal data<\/h2>\n<p>10.1. The User is required to provide or confirm certain personal data. The processing of this data is necessary for PEEK&#8217;IN to process the User&#8217;s request.<\/p>\n<p>10.2. PEEK&#8217;IN complies with the provisions of Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, as amended, and with the provisions of EU Regulation No. 2016\/679 of 27 April 2016 on the protection of personal data. The processing of your personal data by PEEK&#8217;IN is described in our data protection policy, <a href=\"https:\/\/peekin.me\/en\/peekin_privacy-policy\/\">https:\/\/peekin.me\/privacy-policy\/<\/a>.<\/p>\n<h2 id=\"miscellaneous\">Article 11 &#8211; Miscellaneous provisions<\/h2>\n<p>11.1. If any provision of these Terms of Use is invalid, it shall be deemed not to have been included, but this shall not render the remaining contractual provisions invalid.<\/p>\n<p>11.2. Any tolerance or waiver by either party in the application of all or part of the commitments made under these Terms of Use, regardless of their frequency or duration, shall not constitute an amendment to the Terms of Use, nor shall it give rise to any right whatsoever.<\/p>\n<p>11.3.
